Getting a Will Done

Why is it so important to get a Will done in North Carolina?  Here are a few reasons:

1. If you don’t make your wishes clear, your loved ones may fight about it.  The old adage that blood is thicker than water is accurate.  However, you will find that people will fight about property and money, even if they are related.

2. If you don’t make a Will, you will have to default to North Carolina’s law on who gets property after you pass.  One would think that dying with no Will in NC is not a big deal, but it really is.  The laws on who gets stuff after you pass away sometimes do not make a whole lot of sense, and are probably not what you intend.

3. You can decide who manages the estate.  If you have a drug-addict brother or a financially irresponsible sister, you can make sure that is not the person handling your affairs.  You can pick the best person for the job.

4. You can decide what happens to assets given to a minor.  Most people do not want children getting property outright.  Why would you give a kid a substantial amount of money?   You can designate a trustee for this money and can decide when and how much the kids get.

5. You can nominate a guardian for your kids.  Don’t want that drug addict brother or irresponsible sister taking care of your kids if you die?  That is why you can nominate someone for the job, and the Clerk of Court will give great consideration to the person you nominate when selecting a new guardian.
